Wholesale Terms of Sale

These are the Terms and Conditions of Sale of all goods merchandise and services (this "Product" or "Products") supplied by Platinum Pony (ABN 56 540 174 680) and its associated and subsidiary companies (this "Company") to any person, firm or company placing an order with the Company for the wholesale purchase of any Product (this "Stockist" or "Stockists"). These Terms and Conditions shall apply unless the Company agrees, in writing, to vary these Terms and Conditions:
Your core business must be the supply of equestrian products.
Placing an order with Platinum Pony confirms your acceptance of these terms and conditions and your agreement to be bound by them. In the event of a violation of these terms and conditions, Platinum Pony reserves the right to seek all remedies available by law and in equity.
We may at any time and from time to time revise these Terms and Conditions by updating this posting. If the terms are amended they will be effective immediately and will be emailed to you.
May supply products only to their customers. Shall not directly or indirectly, sub-distribute to other stockists, agents or retail outlets inside or outside of Australia.
Platinum Pony Brand may NOT BE SOLD ON EBAY OR ANY OTHER AUCTION FORMAT WEBSITES OR SOLELY ON FACEBOOK under any circumstances, customers must purchase through your own URL when shopping online.
Pricing and GST
Minimum order total of $350 at wholesale prices excluding shipping costs must be met for every order.
To retain wholesale status the minimum order total per calendar year is $1500.
Ordering is made easy through our dedicated wholesale website. Once your wholesale registration has been approved via email you will have access to the Platinum Pony Wholesale Shop. The wholesale price shows automatically and includes GST.
Once you have chosen the items in your order proceed to checkout and click SEND ORDER. We will then calculate your shipping costs and email you an updated invoice for payment.
All orders must be paid in full before being shipped.
Copyright, Trade Marks and Ownership of Rights
The copyright, trade marks and other intellectual property rights of Platinum Pony are owned by or licensed to Platinum Pony (ABN 56 540 174 680) and unless authorised, the use or misuse of them is forbidden.
Approved Stockists are welcome to use any of the images and product descriptions on the Platinum Pony Wholesale website (www.platinumponywholesale.com.au) for the purpose of promoting the Product/s. High res images are available upon request.
The Stockist may not make any unsubstantiated claims in the name of Platinum Pony.
Prices do not include Shipping/Handling, which is calculated and applied to your updated invoice and emailed to you before final payment.
Orders will be shipped asap once full payment is received.
Sorry orders can not be shipped to PO Box addresses.
In-stock items usually ship within 2 - 5 business days, excluding public holidays. If your order contains back-order and in-stock items, the whole order will ship once back-order items are ready.
Estimated delivery dates are approximate and for guidance only. Delivery charges are subject to change without notice. We try our best to have your order dispatched to you as soon as possible, but we are sometimes affected by delays outside of our control. Platinum Pony will not be responsible for late deliveries.
Platinum Pony will check each order before shipping. It is the Stockists responsibility to check the order upon its receipt. Discrepancies must be phoned or emailed through to Platinum Pony within 48 hours of delivery, please quote your invoice number.
Returns and Damaged/Incorrect Stock
Once goods are accepted they are under 'Buyers Care'.
Should you receive any damaged or incorrect stock upon receipt of your order, please phone or email Platinum Pony immediately and quote your invoice number. For damaged goods please photograph box/items. Credits in the form of replaced stock will be issued once stock has been returned.
All orders are final and cannot be cancelled once the order has been confirmed by us. We do not accept return of unsold goods or change of mind. To report a faulty item, please email the details of the damage to email@example.com, and quote your invoice number. Non-delivery must be reported immediately (within 48 hours maximum).
Return of items should occur within 7 business days of receiving them, please send your items back to us via Australia Post or courier with a tracking number. All items returned must be in original unused/unopened condition.
We accept payments of VISA and MasterCard through our secure payment gateway with Shopify on our wholesale website www.platinumponywholesale.com.au. Payment via Direct Deposit on request. Sorry we do not accept Paypal through Platinum Pony Wholesale.
Goods will be shipped once payment has cleared in full.
Accounts (if offered)
Unless otherwise agreed, all orders are payable in full once the shipping costs have been added to your invoice and confirmed through email to you.
All goods supplied remain the property of Platinum Pony until payment is made in full. Any accounts that are outstanding for over 60 days may incur a late payment fee of 3% and may be passed on to debt collection. Any fees involved in recovering the debt is the responsibility of the Stockist.
Sorry, we do not offer exclusivity on our Products.
This Website and all Content of the Website are provided to our Stockists and prospective Stockists "AS IS" and "AS AVAILABLE" and without warranties of any kind, whether express or implied, INCLUDING BUT NOT LIMITED TO, THOSE OF MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON INFRINGEMENT. You acknowledge, by your use of the Website, that your use is at your sole risk. Some jurisdictions do not allow the disclaimer of implied warranties. In such jurisdictions, the foregoing disclaimer may not apply to you.
Limitation of Liability
IN NO EVENT WILL Platinum Pony BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES FOR THE SUPPLY OR DELIVERY OR NON-DELIVERY OF PRODUCTS, INCLUDING, WITHOUT LIMITATION, LOST PROFITS OR REVENUES, COSTS OF REPLACEMENT, BUSINESS INTERRUPTIONS, LOSS OF DATA OR DAMAGES RESULTING FROM USE OF OR RELIANCE ON THE INFORMATION PRESENT, EVEN IF Platinum Pony IS EXPRESSLY ADVISED ABOUT THE POSSIBILITY OF SUCH DAMAGES. In some jurisdictions, limitations of liability are not permitted. In such jurisdictions, the foregoing limitations on liability may not apply to you.
No implication is made that the materials published on this Web Site are appropriate for use outside of Australia. The laws of the state of Western Australia, Australia govern these Terms and Conditions.
